General caravan conditions

Ideal OÜ (Ideal) is the franchise owner of the Avis brand in Estonia. These general terms and conditions apply to all short-term rental agreements with Ideal.

1. The order period

1.1. The renter rents the vehicle for the period specified in the rental contract. The rental period can be extended by agreement between the parties. Prior to the renewal of the lease, Ideal will provide the lessee with a price list for the renewal of the lease, which the lessee will confirm his/her acceptance of by e-mail. The minimum rental period is 5 days.

2. Delivery and return of the vehicle

2.1. Delivery and return of the vehicle will take place at Peterburi tee 47C, 11415 Tallinn. Pick-up and return is between 10:00-12:00, except by special arrangement.
2.2. The renter is obliged to participate in a detailed presentation of the vehicle by an Ideal employee.
2.3. When handing over the vehicle, the hirer must make sure that he/she has received the vehicle in good technical condition, with a clean and undamaged interior. The hirer must check that the damage visible on the vehicle has been entered on the technical condition sheet when the vehicle is handed over. Subsequent claims for damage to the vehicle will not be considered and such damage will be deemed to have been caused by the hirer and will be subject to compensation by Ideal.
2.4. The hirer is obliged to return the vehicle at the time and place agreed in the rental contract. Ideal accepts up to 1 hour’s delay in returning the vehicle, after which an extra day’s charge will apply.
2.5. If the hirer fails to return the vehicle at the agreed time and place, or promptly after early termination of the contract, Ideal is entitled to declare the vehicle wanted and to exercise all its rights under the law to take possession of the vehicle, including authorising the hirer to take back (including remove) the vehicle immediately. If Ideal incurs any additional costs in connection with the foregoing, the hirer shall be liable to reimburse Ideal. When moving the vehicle, Ideal will do all it can to preserve the items left in the vehicle by the hirer, but will not be liable for any damage or loss that may occur to them during or after moving.
2.6. The lessee is obliged to return the vehicle in the same condition as when it was handed over to the lessee, taking into account normal wear and tear. The renter is obliged to return the vehicle, with all tyres, equipment and documents, to the Ideal staff from whom the vehicle was rented or to the place indicated in the rental contract.
2.7. The hirer receives the vehicle with a full tank of fuel and undertakes to return the vehicle with a full tank of fuel. In case of return with a not full tank, the renter will be subject to the fee specified in 4.2.10.
2.8. Upon return, the hirer is obliged to clean the cabin, empty the waste water tank and the toilet tank. In the event of non-compliance, the renter undertakes to pay the cleaning fee referred to in 4.2.8.

3. Requirements for using the vehicle

3.1. As the user of the vehicle specified in the rental contract and as the holder of a valid driving licence, the renter is obliged to know and comply with the traffic rules in force, accepting any fine or other costs resulting from the renter’s breach of the traffic rules.
3.2. A vehicle may be driven by a person who:
3.2.1. is included in the rental contract, holds a valid driving licence and is at least 25 years old;
3.2.2. any other person indicated by Ideal in the rental contract at the request of the lessee and who fulfils the conditions imposed on the driver. The hirer is fully responsible for this person and undertakes to check that he/she complies with the rental contract and the general conditions.
3.3. The vehicle must not be used:
3.3.1. for the carriage of passengers for remuneration (e.g. the provision of transport or taxi services);
3.3.2. towing any other vehicle or trailer;
3.3.3. transporting goods in breach of customs rules or any other illegal act;
3.3.4. by a driver who is under the influence of alcohol, drugs or other prohibited substances;
3.3.5. by a driver who does not hold a licence for the relevant category of vehicle;
3.3.6. for racing or training;
3.3.7. for a study trip;
3.3.8. for off-road use.
3.4. Smoking is not allowed in the cabin. In the event of non-compliance, the renter undertakes to pay the cleaning fee referred to in point 4.2.7.
3.5. When leaving the vehicle, the hirer undertakes to take the necessary precautions (e.g. by locking the vehicle doors) to prevent any accidents or theft. The hirer also undertakes to take the keys and documents (registration certificate and other documents) with them when they leave the vehicle.

4. Fees

4.1. Upon booking, the rental invoice will be issued within 3 working days. More than 1 month before the start of the rental period, it is possible to cancel the rental by receiving a full refund. From 2 weeks to a month you can get a 50% refund on cancellation. Cancellations less than 2 weeks before the end of the rental period are non-refundable.
4.2. When the rental contract is signed, the lessee must pay a rental fee and a deposit. The deposit is payable 5 working days before the rental date for an amount of EUR 900-1200. The deposit will be refunded after the rental if the vehicle is OK.
4.3. The lessee undertakes to pay Ideal:
4.3.1. a rental fee according to the applicable rates, calculated on the basis of the number of rental days and kilometres driven. If the vehicle is returned later than 1 hour after the agreed return time stated in the rental contract, the lessee is liable to pay for the rental period calculated on the basis of the actual return time. If the renter returns the vehicle prematurely, Ideal is entitled to charge the full rental fee stated in the rental contract.
4.3.2. all additional charges (insurance, advance payment, etc.), including VAT as provided for by law, which the lessee has agreed to by signing the rental contract;
4.3.3. a tank refilling fee if the hirer fails to comply with the obligation referred to in point 2.5;
4.3.4. a fine for driving while intoxicated, a traffic offence or any other illegal activity, if the fine is enforceable against Ideal, including if Ideal is fined for allowing an unlicensed driver to drive;
4.3.5. If the lessee has the proper consent of Ideal to leave the Baltic States and the vehicle becomes unroadworthy outside the Baltic States, the lessee undertakes to pay the costs of bringing the vehicle to the rental office of Ideal in the Republic of Estonia. The rental agreement is valid until the transfer of possession of the vehicle to Ideal;
4.3.6. Parking fines, traffic fines, late fines, and towing charges for improper parking or any other reason, if applicable, submitted to Ideal, plus Ideal’s fine or injury administration fee of EUR 35;
4.3.7. An emergency cleaning fee of EUR 200 if the hirer has smoked in the cabin or the interior is so dirty that dry cleaning is necessary to restore the vehicle to its pre-rental condition;
4.3.8. Failure to clean the vehicle, toilet and waste disposal, fine 200 EUR.
4.3.9. It is forbidden to transport animals in the vehicle, fine 200 EUR.
4.3.10. Returning a vehicle with an unfull tank is subject to a fine of 2.5 EUR per litre.
4.4. The renter pays Ideal by bank transfer. In the event of late payment of the rental fee or any other fees provided for in the rental contract and/or the general terms and conditions, the lessee shall pay a late payment penalty of 0.2% of the outstanding amount for each day of delay. In the case of late payment of fees, late payment penalties and fines are considered to be paid first, followed by the principal amount of the fee. In the event of non-payment and/or default by the lessee, Ideal has the right to publish the information concerning the lessee in the register of defaults (including but not limited to the Credit Info database and Ideal’s global database).

5. Responsibility

5.1. The hirer shall be fully responsible for the preservation of the vehicle and for any damage caused to it (including the risk of accidental destruction and damage to the vehicle) which has occurred before the vehicle was inspected and accepted by an Ideal employee.
5.2. In the event of any defects occurring in the vehicle during the rental period, or in the event of the vehicle being involved in an accident or being the object of vandalism, the lessee undertakes to inform Ideal immediately and to follow Ideal’s instructions as to how to proceed. The hirer may not repair any defects in the vehicle himself/herself. In the event of a breach of this clause, the renter is liable to compensate Ideal for any damages (e.g. if original parts of the vehicle have been replaced with sub-standard parts).

6. Insurance

6.1. Ideal will insure the vehicle used by the hirer against any third party damage in accordance with applicable laws. In the event of an insured event, the terms and conditions of insurance agreed between Ideal and its insurer will apply. The renter undertakes to familiarise himself with the relevant vehicle insurance conditions at the Ideal service point before signing the rental agreement.
6.2. In the event of an insured event, the lessee is liable to Ideal up to the amount of the excess. The amount of the renter’s excess depends on the group to which the vehicle belongs, and the amount of the excess is specified in the rental contract. The renter can reduce the excess by paying an additional fee for each day of the rental period, according to the group of vehicles chosen.
6.3. Notwithstanding section 6.2, the following losses are not covered:
6.3.1. damage to the vehicle’s cabin, steering system, under-body or engine compartment, driving on flat tyres, damage caused by snow or ice (e.g. snow or ice falling from the roof of a building) or damage caused when driving on roads other than those on which vehicles are intended to travel;
6.3.2. if the vehicle is stolen and the hirer has not taken the documents and/or keys with him/her when leaving the vehicle in accordance with 3.5. above. In the event of theft of the vehicle, if the renter returns the keys and documents (registration certificate) to Ideal and proves that he took the necessary precautions to ensure the safety of the vehicle, the renter’s liability is limited to the amount of the excess.

7. Emergency response

7.1. The hirer and any driver authorised to use the vehicle are obliged to take all measures to protect the interests of Ideal and the insurer in the event of an accident during the rental period, including:
7.1.1. identify the names and contact details of all parties involved and possible witnesses;
7.1.2. Not admitting guilt or responsibility without the prior consent of the ideal;
7.1.3. not to leave the vehicle unattended or unattended for safety reasons after an accident;
7.1.4. immediately inform Ideal and, if necessary, the police of the accident or theft and remain on the scene until the police have given permission to leave;
7.1.5. prepare a report of the accident or theft to Ideal and deliver it to Ideal within 24 hours of the accident or theft.

8. Amendment and termination of the contract

8.1. The renewal of the rental contract may be concluded by e-mail.
8.2. The rental contract ends on the last date of the rental period indicated in the contract when the vehicle is returned by the lessee.

8.3. Ideal has the right to terminate the rental agreement prematurely if the lessee is in material breach of the agreement. Among other things, a material breach of contract is deemed to occur if:
8.3.1. the lessee uses the vehicle for purposes other than those for which it was intended, including in the ways set out in clause 3.3 of the contract;
8.3.2. the hirer fails to return the vehicle on time and to inform Ideal in writing or by e-mail of the late return of the vehicle.

9. Processing of personal data

9.1. Ideal processes the personal data of the lessee on the basis and in accordance with the applicable legislation. You can find out more about Ideal’s personal data processing policy at Ideal’s office, rental point and on Ideal’s website: avis.ee; myavis.ee, budget.ee.

10. Other

10.1. The General Terms and Conditions are an integral part of the rental agreement between Ideal and the lessee.
10.2. The rental agreement and the general terms and conditions are drawn up in accordance with the laws of the Republic of Estonia and are governed by Estonian law. 10.3.Disputes, disagreements and claims arising from the performance or interpretation of the Contract shall be settled by negotiation between the parties.
during the negotiations. If no agreement is reached, the dispute will be settled in Harju County Court.
10.4.The Renter confirms that he/she has read and agrees with all the terms and conditions and instructions concerning the rental of the vehicle, which are available on the website of the respective brand of Ideal, before concluding the rental agreement.
